Terms of service

This is a translation for convenience; the Polish version is binding.

§ 1. The provider and the services

  1. The provider is Castomo prosta spółka akcyjna with its seat in Wrocław, ul. Powstańców Śląskich 5/212, 53‑332 Wrocław, Poland, KRS 0001188843 (District Court for Wrocław‑Fabryczna, 6th Commercial Division of the National Court Register), tax id PL 8993033031, REGON 542471636, share capital PLN 100,000.00, e‑mail: hello@castomo.com.
  2. The dostepnosc2025.pl site provides: (a) information about digital accessibility and the law; (b) a free check of one web page ("Free check"); (c) a paid check of many pages of a site ("Site check"); (d) a contact form.
  3. The information content is not legal advice. Quotations from legal acts are given in good faith; the wording published in the Journal of Laws and the Official Journal of the EU is binding.

§ 2. Free check

  1. The user gives the address of a publicly available page. The provider opens it in a browser, performs the measurements and checks described on the "Check your website" page and makes a report available at a unique address for 90 days.
  2. The free check requires no registration and no data. Giving an e‑mail address is voluntary and serves to send the report link.
  3. Limits: 3 checks a minute and 20 a day per IP address; the same page address within 10 minutes returns the existing report.
  4. The user declares that they are entitled to check the given page or that the page is publicly available. The provider may refuse to check addresses on private networks, pages that block robots, and in case of abuse.
  5. The report is an automated result: it does not check every WCAG criterion and is not a conformity assessment within the meaning of art. 32(1) of the act of 26 April 2024. The "not checked" section names the rules that were not applied.

§ 3. Site check — order and payment

  1. A site check is ordered from the free check's report by giving the number of pages and an e‑mail address. Price: EUR 1 net per page; at most 200 pages per order (larger — individually).
  2. Placing an order constitutes an offer to conclude a contract. The provider confirms acceptance by e‑mail and issues an invoice (EUR, or PLN at the National Bank of Poland rate). The contract is concluded on confirmation; the check starts once payment is received.
  3. The pages to check come from the sitemap and from crawling the site's links; the user may supply their own list. Pages that could not be rendered are not counted.
  4. The report for each page contains fix instructions and is available at a link for 90 days; on request the provider delivers the report as a file.
  5. A consumer (a natural person ordering outside business) has the right to withdraw from the contract within 14 days; by ordering the check to start before that period ends, they consent to its performance and acknowledge that after full performance the right of withdrawal is lost (art. 38(13) of the Polish Consumer Rights Act).

§ 4. Complaints

  1. Complaints about the services: by e‑mail to hello@castomo.com or in writing to the registered address. We reply within 14 days.
  2. Complaints about the site's accessibility (arts. 35–37 of the act of 26 April 2024): through the same channel, with the content required by art. 36. We reply within 30 days; details in the Accessibility statement.
  3. A consumer may use out‑of‑court dispute resolution (including the European Commission's ODR platform, regional Trade Inspection offices, consumer ombudsmen).

§ 5. Liability

  1. The provider takes care that the measurements are reliable but does not guarantee that a site with no findings in the report meets every legal requirement — some criteria require human assessment.
  2. The provider is not liable for the unavailability of the checked site, its changes after the check, or decisions taken on the basis of the report by third parties.
  3. Towards businesses the provider's liability is limited to the value of the order. The limitations do not apply to consumers to the extent the law does not allow.

§ 6. Accessibility information for the service (art. 32(2)(1) of the act)

  1. The service is provided through a website designed to WCAG 2.2 AA with AAA elements, with three themes (light, dark, high contrast), reading content aloud, keyboard and screen‑reader operation.
  2. The information necessary to use the service, the conformity status, known limitations, the date of the last conformity assessment and the complaints channels are described in the Accessibility statement, which forms part of these terms.
  3. An alternative way to use the service: ordering a check by e‑mail to hello@castomo.com, giving the site's address.

§ 7. Final provisions

  1. We process personal data in accordance with the Privacy policy.
  2. Polish law applies; in disputes with consumers the consumer‑protection rules of the consumer's state of residence apply to the extent they are more favourable.
  3. Changes to the terms are published on this page with a date; orders placed earlier are governed by the terms of the day of the order.
